Our Approach

All investigations are planned and executed using a structured, evidence-based methodology consistent with:

  • applicable Work Health and Safety legislation, including the Work Health and Safety Act 2020 (WA)

  • the Australian Government Investigations Standard 2022

  • established public sector investigation standards

For WHS investigations, we apply recognised methodologies such as ICAM (Incident Cause Analysis Method) to systematically explore contributing factors, assess the effectiveness of systems, and examine the reliability of controls and defences. Findings are evidence-based, clearly reasoned, and documented to support defensible outcomes and practical safety improvement.

The level of evidentiary rigour applied is proportionate to the seriousness of the matter and the potential consequences of any findings.

Investigative work is supported by paralegal capability, strengthening investigation process, evidentiary integrity, and procedural fairness in matters conducted under legal instruction.

Where appropriate, Elect applies a trauma-informed approach, particularly in psychosocial or other sensitive investigations. This includes:

  • establishing trust and psychological safety during interviews

  • being transparent about process, purpose, and confidentiality

  • using open, non-judgemental questioning and active listening

  • minimising the risk of re-traumatisation for participants

Investigations are guided by an understanding of legal principles relevant to WHS and compliance matters. Where investigations may involve legal exposure or regulatory risk, organisations should consider obtaining legal advice at an early stage. Elect recognises the value of early legal engagement and ensures that investigation processes are clearly documented and procedurally sound.

We are experienced in working under legal professional privilege and under the direction and instruction of legal practitioners where required. Where appropriate, organisations may wish to engage external legal advisers. Elect is experienced in working with a range of legal practitioners in this context.
